I'm currently a sprint customer, I'm happy with the service, my plan has the data package too.. But my problem is my phone, It is almost dead, its battery drain very often. I want a new phone, but I can't ask sprint as I'm still under contract. I'm very much impressed with palm pre. My question is

1. If I buy palm pre from others (palm pre for sprint) and can I hook up with my account, Do I need to unlock?
2. Do I need to watch out for any problems if I buy from unknown persons? Is there any way that they can cheat me?
3. Does it work with my current data plan? Does sprint knows that I changed my phone? Does sprint asks any questions? or they want me to convert to everthing plan (which is by default with palm pre)

Does any one here gone through similar kind of process?
